Victoria Peak Capital Ltd, a company limited by shares incorporated in Hong Kong, wants to become an SEHK Exchange Participant to trade for clients. Which pair of requirements must it meet on a continuing basis?
Rule 302 of the Rules of the Exchange requires an Exchange Participant at all times to hold a Stock Exchange Trading Right, to be a licensed corporation for Type 1 regulated activity (dealing in securities) under SFO s.116, to be a Hong Kong company limited by shares and to be of good financial standing and integrity. Clearing participantship is a separate HKSCC status: an Exchange Participant may instead clear through a General Clearing Participant. Rule 302 refers to licensed corporations, not banks registered as registered institutions. Type 2 (dealing in futures contracts) and a futures trading right relate to HKFE, not SEHK. Treating trading and clearing as one membership. Being an Exchange Participant and being a clearing participant are separate admissions.
