Kowloon Bay Securities Ltd (Type 1 only) wants to lend to its own clients so they can buy SEHK shares through it. What is its licensing position?
Securities margin financing (Type 8) means providing financial accommodation to facilitate the acquisition or continued holding of listed securities. Schedule 5 Part 2 excludes financial accommodation provided by a person licensed or registered for Type 1 to facilitate acquisitions or holdings of securities by that person for its client. Kowloon Bay lends to its own clients for purchases it executes, so its Type 1 licence covers the margin business. A stand-alone lender that does no dealing would need Type 8. The exclusion does not depend on the client being a professional investor, and SEHK has no separate margin participantship. Source: SFO (Cap. 571) Sch. 5 Pt 2, definition of securities margin financing, exclusion (iii) (as at October 2026).
Assuming every margin lender needs Type 8. A Type 1 broker financing its own clients' purchases is excluded; Type 8 is for stand-alone margin financiers.
